1. About these terms
This website and online store are operated under the trading name Lead the Standard Resource Shop by Metis Systems Pty Ltd as trustee for the Stapleton Family Trust (ABN 87 675 203 300) (we, us or our).
These Terms of Service apply when you visit this website, create an account or purchase a product from us. By using the website or placing an order, you agree to these terms and our Privacy Policy: https://jackiestapleton.com/policies/privacy-policy.
Nothing in these terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.
2. Eligibility and account information
You must be legally capable of entering into a contract to make a purchase. You agree to provide accurate and current information when placing an order and to keep any account credentials secure. You are responsible for activity conducted through your account unless caused by our failure to take reasonable care.
3. Products and information
We sell digital downloads and resources. We take reasonable care to describe each product accurately, but colours and formatting may appear differently depending on your device, software and settings.
Product descriptions, previews and examples are provided to help you decide whether a product is suitable. You are responsible for checking any stated software, file-format or technical requirements before purchasing.
Our resources provide general educational and informational material. They are not legal, financial, certification or other professional advice, and they do not guarantee a particular business, audit, compliance or career outcome. You remain responsible for applying appropriate professional judgement and obtaining specialist advice where needed.
4. Orders and payment
When you submit an order, you offer to purchase the selected product at the displayed price. An order is accepted when we confirm it and payment has been successfully processed. We may decline or cancel an order where reasonably necessary, including because of a pricing error, suspected fraud or unauthorised payment. If we cancel a paid order, we will refund the amount paid.
Prices are displayed in the currency shown at checkout. Any applicable taxes and charges will be shown before you complete payment. You must use a payment method that you are authorised to use.
5. Digital delivery
Digital products are delivered electronically, usually through a download link or access instructions provided after checkout or by email. No physical product will be shipped unless a product page expressly states otherwise.
You are responsible for entering a correct email address and checking your spam or junk folder. If you do not receive access within a reasonable time, contact us at connect@jackiestapleton.com and include your order details.
6. Licence and permitted use
Unless a product page or separate licence states otherwise, purchasing a digital product gives the purchaser a limited, non-exclusive, non-transferable licence to download and use it for their own personal use or within their own business.
You may adapt editable resources for your own permitted use. You must not resell, redistribute, sublicense, share, publish or make the original or adapted product available to another person or organisation, whether for payment or free of charge. You must not claim our content as your own or use it to create a competing product for sale or distribution.
Copyright and all other intellectual property rights in the website and products remain with us or the relevant rights holder. No ownership rights are transferred to you.
7. Refunds and consumer guarantees
Refunds, replacements and other remedies are handled in accordance with our Refund Policy: https://jackiestapleton.com/policies/refund-policy.
Because digital products can generally be accessed immediately, we do not ordinarily provide refunds for change of mind. This does not affect your rights under the Australian Consumer Law. If a digital product is faulty, materially different from its description or otherwise fails to meet an applicable consumer guarantee, contact us so that we can provide the remedy required by law.
8. Acceptable use
You must not use the website or products unlawfully; infringe another person's rights; introduce malicious code; attempt to bypass security; interfere with the operation of the store; collect information about other users without authority; or use automated means to access or extract website content in a way that places an unreasonable load on the service or breaches these terms.
We may restrict access where reasonably necessary to protect the website, other users or our legal rights. Where practicable, we will explain the reason and provide an opportunity to address the issue.
9. Third-party services and links
The website may use or link to services operated by third parties, including payment, download, analytics and ecommerce providers. Those services may have their own terms and privacy practices. We are not responsible for an independent third-party website merely because we link to it, but this does not limit any responsibility we have under applicable law.
10. Shopify
Our store is hosted by Shopify, which provides the ecommerce platform used to offer our products. Purchases from this store are transactions between you and us, not between you and Shopify. Shopify may process personal information as described in our Privacy Policy and Shopify's own privacy documentation.
11. Privacy
We handle personal information in accordance with our Privacy Policy: https://jackiestapleton.com/policies/privacy-policy. The policy explains how information may be collected, used, disclosed and processed by us, Shopify and other service providers.
12. Reviews and feedback
If you voluntarily provide a review, testimonial or other feedback, you confirm that it is accurate and that you have the right to provide it. You give us permission to reproduce and display that feedback for operating and promoting the store. We will not identify you beyond the information you agreed to make public, and we will handle personal information in accordance with our Privacy Policy.
13. Availability, errors and changes
We may correct errors and update website information when reasonably necessary. If an error materially affects an order you have already placed, we will contact you and provide an appropriate option, which may include confirming the corrected order or receiving a refund.
We do not promise that the website will always be available without interruption. We will take reasonable care in providing the website and digital products.
14. Liability
To the maximum extent permitted by law, we are not liable for loss that was not reasonably foreseeable, was caused by your misuse of a product, or arose because you failed to follow stated technical requirements or instructions.
Nothing in these terms excludes, restricts or modifies a consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified. Where the law permits liability to be limited, our liability will be limited only to the extent permitted by that law.
15. Changes to these terms
We may update these terms to reflect changes to our products, website, business practices or legal obligations. The current version will be posted on this page with its effective date. Changes will apply from the stated effective date and will not retrospectively alter the terms governing a completed purchase unless required by law or agreed with you.
16. Severability and waiver
If any provision is found to be unlawful or unenforceable, it will be read down or severed to the minimum extent necessary, and the remaining provisions will continue to apply. A failure to enforce a provision on one occasion is not a waiver of that provision.
17. Governing law
These terms are governed by the laws of Queensland, Australia. The parties submit to the courts of Queensland and any courts entitled to hear appeals from them, subject to any rights you have under applicable consumer law to bring a claim elsewhere.
